Name, Address, Proprietor and Constitution

The name of the Club is “Bombay Club” and its address is Rataskaevu street 5, Tallinn, Estonia (called the “Club”).

The Club is owned and operated by the Bombay Group, under the operating license of Kopikas Entertainment OÜ, Company number 14045680, Suur-Patarei tn 13, Tallinn, 10415, Estonia (called the “Proprietor”).

These rules shall be known as the “Club Rules” and shall govern the operation of the Club. It is a condition of entry to the Club that all “Guests”  agree to be bound by the Rules (as amended from time to time).

Formal Details

The Club comprises three distinct sub-venues, each offering unique experiences and services:

Bombay Casino – Located on the 2nd floor, providing a premier gaming experience.

The Peacock Lounge – Situated on the 4th floor, offering an exclusive lounge setting.

Velvet – Also on the 4th floor, designed for a sophisticated nightlife experience.

Additionally, the “Bombay Live Studio” operates on the 3rd floor. While Guests are not permitted to enter the Studio, they are welcome to observe its operations through the glass walls from the 3rd-floor gallery.

Guest Identification and Admission

Identification Requirement. All Guests are required to present valid identification at the Club’s reception upon arrival.

Age and Admission Criteria. Admission to the Club is restricted to individuals aged 21 or over who have successfully completed the check-in process as outlined in Section 8 – Admission to the Club.

Access to Casino Services. To participate in gaming activities within the Club’s Casino, Guests must hold a valid Bombay Wallet (https://bombayclub.com/wallet/).

Access to The Peacock Lounge and Velvet. Entry to The Peacock Lounge and Velvet does not require a Bombay Wallet, and Guests may enjoy these facilities without the need for a gaming account.

Admission to the Club

Guests may access the Club through multiple designated entrances, including:

  • The main reception on the first floor
  • Entrances from linked sister properties, including the Burman Hotel and Shang Shi.

Regardless of the entry point, all Guests must undergo the Club’s standard admission procedures, and entry is subject to the conditions outlined in this section.

Admission may be granted for:

  • Casino services (Gaming)
  • Non-gaming services, including dining, lounge events, and other hospitality offerings.

Identification and Verification

Each member and candidate for membership shall provide the Proprietor with valid governmental photographic evidence   of identity, proof of all nationality and proof of their residential address.

Each guest accessing Casino services shall also provide to the Proprietor on request such information, and where necessary proof, as the Proprietor shall require in respect of their source of revenue and source of wealth and such other information concerning their business interests and associates as the Proprietor considers necessary to comply with its obligations under the Money Laundering and Terrorist Financing Prevention Act 2008, as amended and/or other applicable law or regulations. Such information and/or proof may be requested by the Proprietor, and must be provided by the Guest, at the time of accessing Casino services and/or from time to time during the period of membership.

Upon arrival, each Guest will be screened against the national self-exclusion register (HAMPI) maintained by the Estonian Tax & Customs Board. Individuals listed on this register will not be permitted entry until their exclusion period has expired.

Where required under applicable regulations, and subject to such, we are required to perform Know Your Customer (KYC) verification before admission is granted.

Guest Register

The Club shall maintain a register recording the name of each Guest upon entry.

Additional details may be recorded as required by the Club or in compliance with legal and regulatory obligations.

Facial Coverings and Identity Verification

Guests wearing items that obscure their face will be required to remove them briefly for age and identity verification.

If requested, this process may be conducted in a private room/area by a member of Club staff of the same sex.

Dress Code

Although the Club does not have a formal dress code, Guests are expected to dress in an appropriate and presentable manner.

Management reserves the right to determine whether a Guest’s attire is acceptable for entry or continued access to the Club.

Guest Fees

A Guest fee, where appropriate, shall become due and payable on the election of a member and reoccurring on an annual basis.

Guest fees (if and where applicable) will be disclosed in advance on an annual basis and will be based in part on the historical benefits and services utilised by the member.

Right to Refuse Entry

At management’s discretion, the Club reserves the absolute right to refuse entry or withdraw access to any Guest without obligation to provide a reason.

This policy applies to all designated entry points, including those from sister properties, as well as any specific area or service within the Club.

Address of Guests and Notices

Each member shall inform the Proprietor forthwith of any changes to their residential address and or contact details provided for the facilitation of accessing Gaming services.

Any notice required by these Club Rules to be given, may be sent by pre-paid letter, email addressed to the Guest at the last physical or address , and or another digital and direct from of communication to which they have furnished to the Proprietor.

Rights and Liabilities of Guests

Every Guest of the Club shall, subject to these Rules, be entitled to use and enjoy (in common with other Guests of the Club) the premises and the facilities provided by the Proprietor but shall not by reason of their access alone be under any financial liability for the day-to-day costs of the Proprietor.  Some areas of the Club may be reserved for certain Guest types only.

The Proprietor may either deny access to anyone acting in a disorderly manner or anyone who in its judgement is intoxicated or otherwise of impaired ability or may ask him or her to leave the Club.

Guests are:

Prohibited from bringing alcohol or illegal drugs onto the premises and may be refused entry if attempting to enter the premises with alcoholic beverages or if found in possession of illegal substances.

In the interests of safety members and their guests must be prepared to permit the inspection of any hand luggage, bags, carriers or the like.

Cameras, or any other recording or transmitting device may not be used in the Club without express awareness and permission from Club management.

The Proprietor will not discriminate, nor knowingly permit others to discriminate, against staff or members and their guests on the grounds of sex, age, race, disability, sexual orientation, gender reassignment, marital/civil partnership status, pregnancy/maternity, religion and/or belief. The Proprietor may suspend or terminate the relationship if the member discriminates against staff, another member or a guest on any of these grounds.

The Proprietor will not tolerate disruptive behaviour. Behaviour will be deemed ‘disruptive’ if the Proprietor’s property is intentionally damaged or threatening, abusive, indecent or insulting words or behaviour are used towards other Guests, their guests and any staff members, or if the Guest is under the influence of illegal drugs or excessive alcohol.

Confidentiality, Privacy, Data Collection and Data Processing

Guests are required to respect the confidentiality of other Guest’ affairs, which are conducted on the Club premises, and must not under any circumstances divulge such matters to persons unconnected to the Club.

As part of the application process, all Guests are made aware of and acknowledge the Club’s Privacy Policy. This is also published and available within the Club and on the Club website Bombay Club Privacy Policy . The Proprietor will obtain and use personal data about Guests in accordance with the Club’s Privacy Policy and Data Protection legislation.

As set out in the Privacy Policy, the Proprietor is required by law to process and retain certain information provided by Guests and applicants, obtained by the Proprietor pursuant to the Privacy Policy whether, their application is granted or not.

The Club enforces a strict ‘no press’ policy, prohibiting entry to any press or media representatives for the purpose of press-related inquiries, interviews, or reporting unless explicitly pre-approved by the Club’s management.

Guests are prohibited from the using the Clubs name, address, colours, trademarks, photographs, logo, or any other identifying features of the Club (the ‘Club Marks’) in any form, including but not limited to advertisements, marketing materials, invitations, prospectuses, or for any business-related purposes, without prior written consent from the Club.

Security

The Proprietor may employ the use of identification and security cameras with audio recording and/or other security systems, both inside and outside the premises for the purposes of ensuring the safety and security of the Club and its Guests, and to detect and prosecute crime.  Without limitation, the Club will prosecute cheating on its gaming tables and, fraud, theft and any illegal activity subject to the national laws of Estonia.

Byelaws

The Club may from time to time make, vary and revoke byelaws (not inconsistent with these Rules) for the regulation of the internal affairs of the Club and the conduct of Guests. Byelaws shall be deemed to be incorporated into the Rules of the Club.

Cancellation and Suspension of Services

The Proprietor may in its absolute discretion at any time without notice and for any reason, refuse access, suspend and/or cancel the membership of any member of the Club without giving any explanation.

Any member whose membership is suspended or cancelled under this Rule 12 shall immediately be excluded from the Club (and potentially other services managed by such) and shall forfeit all the privileges of membership including any uncrystallised loyalty or other bonuses and shall immediately pay any sums due to the Proprietor.

Player Protections

The Proprietor complies with the requirements of the Estonian Gambling Act and the regulations set forth by the Estonian Tax and Customs Board.

In accordance with responsible gambling obligations, any player who wishes to control their gambling may voluntarily self-exclude through the HAMPI self-exclusion register, maintained by the Estonian Tax and Customs Board. Self-exclusion is for a minimum period of 6 months and applies to all licensed gambling establishments in Estonia.

Customers may apply for self-exclusion via the HAMPI portal, and upon registration, their details will be removed from the marketing databases of all licensed gambling operators. The Proprietor will take all reasonable steps to prevent self-excluded individuals from gambling on the premises but shall not be liable for any losses incurred by a self-excluded individual who circumvents these controls.

By entering the casino, all patrons agree to the following:

  • Self-excluded individuals will not enter or attempt to enter the premises or seek to gamble, either directly or through a third party.
  • The Proprietor is not liable for any losses incurred by self-excluded persons who engage in gambling at the casino.
  • Any funds staked or winnings obtained by a self-excluded individual, whether directly or through a third party, shall be forfeited.

Self-excluded individuals will not enter or attempt to enter the premises or seek to gamble, either directly or through a third party.

The Proprietor is not liable for any losses incurred by self-excluded persons who engage in gambling at the casino.

Any funds staked or winnings obtained by a self-excluded individual, whether directly or through a third party, shall be forfeited.

Resignation of Guests

Notice of the resignation of any Guest must be given in writing and shall take effect when received by the Proprietor.

Club and Guest Property

No member or a guest shall remove any property, newspaper, periodical or other thing belonging to the Proprietor from the Club premises.

The Club and the Proprietor do not accept any responsibility for any loss or damage to Guest property on the premises, whether or not entrusted to the care of the Proprietor or its employees.

Bills and Funds

Members must pay their bills before they leave the Club premises unless they have written authority from the Proprietor not to do so.

The Proprietor reserves the right to withhold funds where there is knowledge or suspicion that those funds have been exclusively or partly obtained and/or transferred unlawfully whilst full investigations are concluded.

The Proprietor has a contractual right of set off. The Proprietor may at its sole discretion withhold from members and/or their guests the payment of stakes and/or winnings, including funds held through loyalty programmes for the purposes of recovery (in whole, or in part) of outstanding debts owed to the Proprietor. Guests authorise the Proprietor, in its absolute discretion, to apply any and all chips they may redeem to reduce any outstanding debts owed to the Proprietor.

Guests acknowledge that the Proprietor will seek to recover any debts incurred by the member in full and will be entitled to interest at the rate of 8% per annum of such a debt from the date it was incurred. Members agree to pay the Proprietor’s costs of collecting any debt incurred by them, including legal fees and costs.

Animals

Animals (other than guide dogs) are not allowed in the Club without the prior-written consent of the Proprietor.

Opening Hours

The Club shall be open and prepared to receive Guests daily during such hours as the Proprietor shall determine from time to time.

Liquor Licensing Hours

The sale or supply of intoxicating liquor in the Club shall be as determined by statutory provision and local regulation.  The Proprietor reserves the right to cease serving alcohol to any individual without giving a reason.

Gaming

Guests are personally responsible for the frequency and financial commitment they outlay on their gaming activity. The Proprietor will not be held liable for any member’s or their guest’s losses incurred in gaming. The Proprietor will vigorously pursue, including resorting to legal processes, any debt incurred across its offered services, by a Guest, in any jurisdiction.

No game of chance shall be played in the Club otherwise than in accordance with the Proprietor’s written rules for such game .

Information is provided in several ways throughout the Club and upon its website, to inform you of the rules of each type of casino games available to be played, including side bets and jackpot/bonus games and a guide to the house edge on each game. Please read these carefully and if you have a question about a game, ask any manager.

No device (whether electrical, mechanical, or otherwise), trick or deception may be used by any person whether on or off the premises for the purpose of which is intended to gain an unfair advantage in or to influence any gaming in the Club. Breach of this rule will invalidate any gaming so affected and any winnings or stakes hazarded in connection therewith shall be forfeited.

Gaming chips issued by the Proprietor remain the property of the Proprietor and must be returned or redeemed (as appropriate) on demand.

The Proprietor is prohibited from providing any credit in connection with gambling, or participating in, arranging, permitting or knowingly facilitating the giving of credit in connection with gambling. Therefore:

The Proprietor will not accept payment for gaming chips with a credit card/cheque.

The Proprietor will not provide cash back facilities for use with credit cards. Members are free to use money services across the Club operations.

Deposited Funds

Any funds deposited by members for use in future gambling are held in a bank account and will be made available for the member to draw down.

A deposit will be regarded as inactive if the member has not visited the Club for a period of two years. In these circumstances, the funds will be returned to the member, subject to applicable laws and regulations. If the member cannot be located or refuses to accept repayment, the Proprietor may dispose of the funds in its absolute discretion.

Monies deposited and held by the Proprietor are subject to rules of the Proprietor, in force from time to time. In accordance with the issuance of an Estonian Tax and Customs Board (Maksu- ja Tolliamet, or EMTA) operating license. You are advised that funds held on deposit are not protected in the event of the Proprietor’s insolvency.  This includes all monies held in customer accounts whether through transfer, chip or cash deposited or funds in a player account that has been earned.

Gratuities and Donations

Any gratuities given by customers to staff are pooled and distributed amongst the employees concerned.

Complaints and Disputes

All complaints shall be delivered in writing to the Administrator or a director of the Club who shall bring them to the notice of the Proprietor. Any complaints shall be investigated and managed at management discretion.  No Guest may reprimand an employee of the Proprietor.

Any complaints or disputes about the conduct or outcome of gaming within the Club will be dealt with in accordance with the Proprietor’s written Gaming Complaints Resolution Procedure. The Proprietor takes due regard of the Consumer Protection and Technical Regulatory Authority (CPTRA), when addressing consumer complaints and disputes connected with Gambling services.

These Club Rules and any dispute arising out of or in connection with the Rules or otherwise in the course of our services relationship shall be governed by Estonian Law. Guests irrevocably submit to the jurisdiction of the Courts of Estonia and in respect of any such dispute. Guests agree that they may not bring proceedings against the Proprietor in any jurisdiction other than Estonia. At its election, the Proprietor may bring proceedings against any member in the Courts of Estonia and and/or any other court with jurisdiction. To the extent permitted by law, the Proprietor may take concurrent proceedings in any number of jurisdictions.

Alterations, Revocation etc, of Rules

These Club Rules may be altered, revoked, or supplemented at any time by the Proprietor. These Club Rules, as amended from time to time, shall be kept and made available to all Guests upon entry and as available on its website and all Guests shall be deemed to have full knowledge thereof.

Governing Law and Jurisdiction

These Rules and any dispute arising out of or in connection with it and/or the Bombay Groups collection, processing, use and/or disclosure of Personal Data shall be governed by and construed in accordance with Estonian and European Law

You agree that you irrevocably submit to the jurisdiction of the Courts of Estonia in respect of any such dispute.

You agree that you may not bring proceedings in respect of any such dispute against the Bombay Group in any jurisdiction other than Estonia.

If any provision of these Club Rules is found to be illegal, invalid, or unenforceable, the remaining provisions shall remain in full force and effect.
